TERMS AND CONDITIONS
Alecassandra Vacation Villas are privately owned. It is understood that these villas are to be used but not damaged or neglected. The tenant shall be responsible for any damage beyond normal wear and tear. The property is not to be treated as a hotel or motel. Occupancy is limited to the number of people stated in the rental agreement. Over occupancy will result in immediate eviction. Only those designated in this agreement, as tenant shall occupy the villa unless written consent of owner or owner's agent is obtained. Tenant agrees to abide by all occupancy rules of Alecassandra Vacation Villas.
CANCELLATION TERMS: There is no credit given in case of early departure or changes to a reservation. 1.) Tenant may have the option to cancel a weekly reservation by providing owner or owner's agent with written notice at least 90 prior to check in date and pay a $250.00 cancellation fee. Nightly rentals are non-refundable once billed.
Owner reserves the right to not accept cancellation for the high season months of January, February and March. 2.) If tenant cancels this agreement, less than 90 days prior to check in date, tenant will be obligated to pay all rent payments as specified in this agreement and all monies received by owner or owner's agent shall be retained by owner, unless owner or owner's agent is able to re-let the villa for the same price and terms. Trip insurance is recommended.
ACCOMMODATIONS: Due to circumstances beyond the control of the owner or the owner's agent, If this villa should become unavailable, every attempt will be made to relocate tenant to a comparable villa. Should a like villa not be available, all advance funds will be refunded to
tenant. Owner or owner's agent shall not be responsible for any costs tenant may incur for travel or other arrangements in the event of cancellation by owner or tenant.
PAYMENTS: A reservation deposit for all rentals will be 25% and the entire rental balance will be due 90 days prior to your arrival. If your reservation is being made within the 90 days prior to your arrival, full payment is required at time of reservation.
All nightly rentals require full payment at time of reservation and are non-refundable, once billed. Seasonal Rentals require a reservation deposit of 50% and full balance is due 90 days prior to arrival.
CHECK-IN: Check-In time is 4:00 PM on the scheduled day of arrival. On high volume days check in is not guaranteed until 5:00 PM. Villa access information will be in your confirmation email.
CHECK-OUT: Check-Out time is 10:00 AM on your day of departure. If checkout time is not adhered to, there will be an additional day charged to your tenancy of $250. Key return is to owner's agent as specified in rental
AMENITIES: Tenant agrees to hold owner and owner's agent harmless in the event of failure or non-availability of any amenity.
VEHICLES: No boats, motor homes trailers, large trucks, commercial vehicles or motorcycles shall be permitted on the premises unless written consent from owner or owner's agent.
SMOKING: All of our villas and our property are designated as non-smoking. All smoking must be away from all buildings, patio's. porches, and pool area. Failure to adhere to this will result in a $500.00 fine.
PETS: Pets are not permitted on our property or in our villas. Failure to adhere to this constitutes a serious violation and will result in a $500.00 Fine.
MAINTENANCE: In the event of failure of any equipment, appliance, air-conditioner, etc., tenant is required to notify the owner or owner's agent immediately and repairs will be made. Tenant however expressly waives and relinquishes any rights or claims against the owner, or owner's agent for any damage that may result to tenant from lack of maintenance repair or defect, including owner and owner's agent's ordinary negligence. All personal property of tenant kept on the premises is at the risk of the tenant. The owner and owner's agent are not
responsible for articles left on the premises.
Owner shall be responsible for maintaining the villa unless damage is caused by tenant's misuse or neglect. Tenant agrees that no rent reduction or abatement will be given unless villa is deemed to be completely uninhabitable by the governing authorities. Tenant may not make any changes to the villa and must put furniture back in its original placement if moved. Owner or Owner's Agent will order repairs in a timely manner, once tenant gives notification, but owner or owner's agent has no control over the scheduling availability of vendors. Any work performed in the villa or buildings or nearby buildings or grounds or common amenities is not reason for refund or cancellation of this agreement at any time, including after check-in date. Owner or owner's agent shall not be liable for any losses or damages, including incidental or consequential damages, including those caused by owners failure to perform repairs or maintain the villa.
SECURITY DEPOSIT: A Security Deposit of $250.00 is required with every reservation and shall NOT be applied to the rent by Tenant. Security deposits will be refunded after satisfactory inspection of the villa and verification that all items are still in villa. Verification may delay return of deposit, therefore tenant waives rights to receive deposit within 30 days of departure and agrees to allow at least 60 days for refund. Any damages or excess cleaning charges or damages will be deducted from the Security Deposit and if any additional sums are due over and above the amount of the security deposit, tenant agrees to make payment on demand from owner, or owner's agent immediately.
Security Deposits shall be returned by check in the US Mail. Security Deposits are held at Whitney Bank, Bradenton, FL by owner and tenant agrees if security deposit is held in interest bearing account, all interest is paid to owner.
DEPARTURE CLEANING FEE: Tenant agrees to pay a $150.00 departure cleaning fee plus applicable taxes. Accommodations are to be maintained in a neat and clean condition. Tenant shall clean all dishes and remove all garbage from villa before departing. Tenant is NOT required to launder last minute linens/sheets/towels prior to check-out. Tenant shall NOT be responsible for making up beds at check-out. If owner or owner's agent determines, in its sole discretion, that excessive dirt, furniture stains, carpet stains, or other damage is present, additional charges will be assessed and charged to the security deposit and/or charged in addition to the security deposit. Every care is given to insure the villa is satisfactory upon guest arrival. Tenant is to report any
deficiencies to owner or owner's agent immediately upon arrival, NOT at departure.
TELEPHONE/CABLE/INTERNET: Telephone is provided for the tenant's convenience in making local calls only. Our telephones are equipped with long distance blocks which will limit tenants usage. Cable and Internet services are provided in all of our villas. Tenant agrees not to add or change any services to the cable or internet. If tenant does not adhere to this stipulation, tenant agrees to pay for all expenses incurred as a result of these changes, in addition to a $50.00 Administration Fee payable to the owner or the owner's agent.
PHYSICAL ADDRESS: Our business mailing address and physical address of our villas are not the same. Please verify correct mailing address with owner or owner's agent prior mailing items to us or having your mail forwarded.
MISCELLANEOUS CHARGES: Tenant shall be assessed Locksmith charges, if any, for each key, pool tag, or parking pass lost and not returned to owner or owner's agent at check-out. Such charges will be deducted from the Security Deposit. Tenant agrees to pay the owner or owner's agent the greater of $50.00 or actual cost immediately to provide access to the villa in the event of a lock out. If after 10:00 pm, the tenant agrees to pay the greater of $100.00 or actual cost.
INDEMNIFICATION: Tenant shall indemnify the owner and owner's agent against any expenses, loss to liability paid, suffered or incurred as a result of any breach by tenant, tenant's agents, servants, employees, visitors, invitees, or license of convents of conditions of this lease, or as a result of tenant use or occupancy of the premises of the carelessness, negligence or improper conduct of tenant or the aforesaid mentioned parties. Tenant agrees to reimburse owner or owner's agent for any fine or
penalty which may be imposed upon owner by any governing authority by reason of any violation upon the premises through the use thereof or fault of the tenant herein his agents or servants. Tenant agrees to pay all costs incurred by owner or manager in enforcing by legal proceedings or otherwise, the terms of this agreement and the rules and regulations of the Alecassandra Vacation Villas, including reasonable attorney's fees.
Because there are NO LIFEGUARDs or other attendants at the swimming pool, tenants are expressly responsible for the safety of themselves, members of their family and guests using the swimming pool, or other recreational facilities, and in so using or permitting to be used, specifically waive any and all liability claims expressed or implied against the owner or owner's agents.
ATTORNEY' FEES: Should it become necessary for owner or owner's agent to employ an attorney to enforce the terms and conditions of this agreement, tenant shall be responsible for all costs and attorney fees whether or not suit is filed.
RIGHT OF ENTRY: Alecassandra Vacation Villas are NOT listed for sale. Owner and Owner's agent and or its representatives have immediate right of entry in cases of emergency, repairs or to protect or preserve the premises. Tenant shall not alter premises or change or add locks without prior written consent of owner or owner's agent. Tenant is not permitted to have access to any rooms, storage areas or closets which are designated to be exclusively for the use of the owner or owner's agent.
TIME IS OF THE ESSENCE: Time is of the essence with respect to all time periods contained in this
agreement edit given in case of early departure or changes to reservation. Once reservation is billed, tenant may have the option to cancel this agreement and pay a $250.00 cancellation fee to owner by providing owner or owner's agent with written notice by certified mail at least 90 prior to check in date. Owner reserves the right to not accept cancellation for the HIGH SEASON months of January, February and March. If tenant cancels this agreement, less than 90 days prior to check in date, tenant will be obligated to pay all rental payments as specified in this agreement and all monies received by owner or owner's agent shall be retained, unless owner or owner's agent is able to re-let the villa for the same price and terms.
